The Supreme Court ruled that the regulations governing election commissioner appointments are unalterable.

The Supreme Court ruled on Thursday that the act designating election commissioners cannot be blocked at this time because it may lead to uncertainty in the lead-up to elections.

The ruling came a few days after the Supreme Court turned down a motion to stop the appointment of new election commissioners (ECs) in reaction to a dafabet 2023 regulation that excluded the Chief Justice of India from the panel of candidates.

The petitioners were advised by Judges Sanjiv Khanna, Dipankar Datta, and Augustine George Masih to present a different case that focused on postponing the election of ECs.

The Chief Electoral Commissioner and other Election Commissioners (Appointment, Conditions of Service and Terms of Office) Act, 2023, will not be temporarily delayed, the top court ruled on Thursday. The court cited the electoral commission’s independence from the “thumb of executive.”

The Supreme Court said that it will review the primary petitions challenging the validity of the 2023 Act and asked the Center for a written response within six weeks. The Court then set a hearing for August 5.
